Policy Overview
PowerReviews is committed to collecting, displaying and sharing consumer-generated ratings, reviews, comments, photos, videos, questions and answers, and other content (“Content”) on behalf of our clients that is suitable and authentic - meaning the content has not been fabricated, modified, selectively published or fraudulently collected to the best of PowerReviews' and the client's knowledge.
To that end, the PowerReviews Authenticity Policy (this “Policy”) outlines the requirements for Content submitted to the PowerReviews platform (the "Platform") and published to our client websites, and if applicable, syndicated across the PowerReviews Network, including its partners’ networks.
All clients must comply with the PowerReviews Authenticity Policy and the PowerReviews Moderation Policy unless they have received written agreement from PowerReviews for an exception. Failure to comply with this Policy may lead to removal of a client’s Content from the Platform and/or termination of a client’s access to the Platform.
This Policy is intended only to assist you in meeting our requirements for Content that is authentic and suitable. With this Policy, we do not intend to provide legal advice or to imply that if you comply with this Policy, you will be in compliance with all laws, rules, regulations applicable to your collection and publication of Content via the Platform. You are solely responsible for ensuring that any Content submitted to the Platform complies with this Policy, and all such applicable laws, rules, and regulations.
PUBLISHED CONTENT
All Content submitted through the Platform, whether new Content or legacy must meet the following standards to be published.
1. Content Must be Authentic
- Fraud-free content: Content may not be fraudulent or false and must comply with the Consumer Review Fairness Act and all other applicable laws, rules, regulations, and regulatory or administrative orders and guidelines. PowerReviews passes all Content through a fraud identification and a fraud prevention process upon content submission.
- No Advertising: Content may not include any form of advertising.
2. Content Must include Clear and Conspicuous Disclosures and Badges
Content that is submitted by you must be displayed with an appropriate badge clearly visible to site visitors.
- Incentives and Sampling Programs: Content submitted by an individual with a relationship to you, or as a result of receipt of incentives such as free or discounted products or services, monetary rewards, loyalty points, coupons, referral bonuses or the like, must include an appropriate disclosure or be displayed with an appropriate badge.
- Sweepstakes: Content that is submitted as a result of or in exchange for being entered into a sweepstakes for goods, services or financial benefits must include an appropriate disclosure or be displayed with an appropriate badge indicating the consumer’s participation in a sweepstakes program.
- Staff reviews: Content that is submitted by an employee must include an appropriate disclosure or be displayed with an appropriate badge.
- Third-party content: Content displayed on your website that originated elsewhere must comply with the PowerReviews Authenticity Policy and contain disclosure of where the content originated. (e.g. a logo or badge).
- PowerReviews Network: Content to be syndicated across the PowerReviews Network must include an appropriate disclosure of where the Content originated and be displayed with an appropriate badge.
3. Content Must be Suitable
- No use of profanity or obscene language: Content may not be offensive, profane, illicit, or otherwise indecent or inappropriate.
- Libelous and Misleading Content: Content may not be libelous, defamatory, or otherwise untruthful or misleading.
- Discriminatory: Content may not include discriminatory comments connected to race, national origin, gender, sexual orientation, or physical handicap.
- Infringing: Content may not infringe, misappropriate, or violate the intellectual property rights of any third party, including without limitation, copyright (including moral rights), trademark, trade secret, or rights of privacy or publicity.
- Private Content: Content may not include any consumer contact information or other personally identifiable information.
- Illegal or Harmful Content: Content may not promote any illegal activity or violate any law, statute, ordinance or regulation. Content may not threaten, harass, abuse, harm, or cause injury to others, or otherwise promote violence.
- Damaging Content: Content may not include any malware, spyware, viruses or similar harmful code.
NO ALTERATION OF CONTENT
PowerReviews does not alter Content, in any way, nor do we allow our clients to alter submitted Content. Any Content that is published to your site or syndicated across the PowerReviews Network appears as originally written, including all grammatical errors.
MODERATION POLICY
Content submitted to the Platform is subject to moderation processes that include automated filtering and human verification, as more fully described in the PowerReviews Moderation Policy. While our moderation processes are designed to assist in determining whether Content complies with this Policy, they are not meant to replace your review of Content.
MANIPULATIVE PRACTICES
We will NOT tolerate practices intended to manipulate the results of the consumer-review process, including without limitation:
- Moderating by keywords or engaging in any other conduct with the intent to prevent or delay publication of unfavorable reviews or ratings.
- Providing incentives to influence the outcome of a review or rating.
- Pre-screening consumers, such as using a simple star ratings submit form to prevent detractors, in an effort to encourage the submission of reviews anticipated to be positive or prevent (or delay) detractors from writing reviews or diverting detractors to a customer service feedback form instead of a write-a-review form.
- Reusing any review or rating out of context in a manner that alters the author’s intentions or suggests such review or rating describes a product or service materially different than that for which it was originally submitted.
CHANGES TO THIS POLICY
PowerReviews may, in its sole discretion, update the Authenticity Policy from time-to-time as it deems necessary to further the purpose of the Policy. If PowerReviews makes a material change to this Policy, we will notify you at least 30 days before the change goes into effect.
